RENTAL AGREEMENT AND LIABILITY WAIVER

This Rental Agreement and Waiver of Liability entered into by and between Auntie Snorkel LLC (hereinafter “Auntie Snorkel”) and the Undersigned (hereinafter “Guest”), is done so knowingly and voluntarily according to the following terms and conditions (please check box next to each item):
Guest represents that he/she is capable of safely operating and handling any and all rented equipment and finds said equipment in good working order and condition. Guest represents that he/she has adequate skills, knowledge, and experience to safely complete the planned activity and that adequate preparations have been made to ensure the Guests safety during the rental period.(Required)
Guest shall bear all risk and responsibility for damage, loss, or theft of all rented equipment, and shall pay to Auntie Snorkel the cost to repair, if possible, or the full cost for replacement if repair is not possible. Guest also agrees to allow Auntie Snorkel to charge the Guests credit card used to reserve the rental for the cost of the rented equipment if the Guest fails to return the rented equipment (by signing this agreement you authorize such charges) mask $69, snorkel $29, fins $49, paddle $140, bicycle $400, GoPro $300, SUP $800, SUP fin $50, chair $45, umbrella $35, boogie board $65, 8' surfboard $140, 10' surfboard $650.(Required)
Guest shall wash gear free of sand. Guest shall return all equipment by the return date and time indicated on the rental contract and in the same condition as received. $5 is charged for excessively sandy gear.(Required)
Guest understands and accepts that there are inherent dangers and risks associated with the use of the equipment. As such, Guest agrees to hold Auntie Snorkel indemnified against any and all injury or death of the Guest and Guests family or household members in connection or as a result of the use and rental of Auntie Snorkel’s equipment. Guest further expressly releases and holds harmless Auntie Snorkel, its employees, owners, and officers, from any liability for negligence, expense or cost, including attorneys fees, arising out of damages to the person or property of the Guest occurring during the course and as a result of the rental of the equipment. Guest is fully responsible for ALL damages that occur while renting from Auntie Snorkel. Damage caused to others property is solely Guests responsibility and releases Auntie Snorkel of all liability.(Required)
No refunds are provided on rental equipment.(Required)
Non-Compliance to the above terms may result in your injury or exposure to liability for the rented equipment.
